These Terms of Use ("Terms") govern your access to and use of gryphon-industries.com (the "Site") and any software products, including RooiKat Apex, developed and marketed by Gryphon Industries ("Gryphon Industries", "we", "us"). By accessing the Site or purchasing a product, you agree to be bound by these Terms. If you do not agree, do not use the Site or purchase our products.
All Gryphon Industries products, including RooiKat Apex, are sold exclusively through the official MetaTrader 5 Marketplace operated by MQL5 Ltd. ("MT5 Marketplace"). Gryphon Industries does not process payments, store payment card details, or handle checkout directly on this Site. Your purchase is subject to the MT5 Marketplace's own terms of service, refund policy, and payment processing terms, which take precedence over these Terms for any matter relating to the purchase transaction itself.
Subject to your compliance with these Terms and the terms of the MT5 Marketplace, Gryphon Industries grants you a non-exclusive, non-transferable, revocable license to install and use the purchased Expert Advisor on MetaTrader 5 trading account(s) linked to your own MQL5 account, for as long as your license remains valid under MT5 Marketplace rules. This is a license to use the compiled software — it is not a sale of the underlying source code, strategy logic, or intellectual property.

Prices displayed on the Site (including any introductory or "intro" pricing) are subject to change without prior notice. Where an introductory price is offered ahead of a version update (for example, a price increase tied to a "v2" release), the specific timing of that update and resulting price change is at Gryphon Industries' discretion. Buyers who purchase at a given introductory price retain that license at no additional cost; the price change applies to new purchases only, not to previously purchased licenses.
All content on the Site — including but not limited to text, graphics, logos, the RooiKat Apex name and branding, dashboard design, and documentation (such as the Optimization Guide) — is the property of Gryphon Industries or its licensors and is protected by applicable copyright and trademark law. Nothing in these Terms transfers any intellectual property rights to you beyond the limited license described above.
Gryphon Industries products are provided "as is" and "as available", without warranty of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement. Gryphon Industries does not warrant that any product will be uninterrupted or error-free. To the maximum extent permitted by applicable law, Gryphon Industries and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or trading losses, arising out of or related to your use of, or inability to use, any Gryphon Industries product or the Site, even if advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability is limited to the fullest extent permitted by law.
Gryphon Industries reserves the right to terminate or restrict your access to a product license if we determine, in good faith, that you have violated these Terms, including the Restrictions above. License issuance, suspension, and revocation for MT5 Marketplace purchases are also governed by MQL5's own account and licensing policies.
We may revise these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site or a Gryphon Industries product after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by generally applicable law, interpreted in good faith and without regard to conflict-of-law principles. Any dispute arising under these Terms should first be raised with Gryphon Industries directly so it can be resolved informally wherever possible. Nothing in this section limits any statutory rights you may have as a consumer under the law applicable to you.
